TOPIC: National Disability Insurance Scheme (NDIS)- Current challenges and How can one resolve disputes with the Scheme administrators and service providers and appeal rights ?
The seminar looks at decisions to approve a statement of participant supports under the NDIS Act and the process of merits review in the Administrative Appeals Tribunal (AAT) with respect to those decisions. In particular, the presentation will focus on the incongruities that arise between the decision-making principles that underpin the NDIS Act and the merits review mechanism provided by the AAT. In this context, the presentation will consider the challenges of giving effect to the key principles under the NDIS Act, such as self-determination, choice and the involvement of participants in decision-making, within the framework of the AAT and its procedure.
